These Terms of Service ("Terms") govern purchases from and use of SongsMadePersonal.com ("SongsMadePersonal," "we," "us," or "our"). By placing an order, you acknowledge that you have read, understood, and agreed to these Terms.
1. Custom-Produced Digital Product
SongsMadePersonal creates personalized songs based upon information, preferences, names, stories, themes, musical styles, and other instructions supplied by the customer.
Each song is a custom digital product created specifically for an individual customer. Because work may begin shortly after an order is submitted, orders cannot be canceled once production has begun.
2. Customer Responsibility for Submitted Information
You are responsible for reviewing all information submitted with your order for accuracy, including names, spelling, pronunciation guidance, dates, relationships, events, stories, and other details.
SongsMadePersonal is not responsible for errors resulting from incorrect, incomplete, ambiguous, or misleading information supplied by the customer.
You represent that you have the right to provide all information, photographs, recordings, text, lyrics, or other materials you submit to us and that our use of those materials to fulfill your order will not violate another person's rights.
3. Creative Discretion
Personalized music is inherently creative and subjective.
While we will make reasonable efforts to incorporate the information and preferences provided with your order, the finished song may not sound exactly as you imagined.
Unless expressly promised as part of the purchased service, preferences concerning melody, instrumentation, vocal characteristics, tempo, arrangement, phrasing, genre, emotional tone, or similar artistic characteristics are requests rather than guarantees of a particular result.
Personal dislike of a creative choice does not, by itself, mean that the product is defective or that the service was not provided.
4. AI-Assisted Production
SongsMadePersonal may use artificial intelligence and other digital production tools as part of the songwriting, vocal, musical, arranging, editing, mastering, or production process.
By purchasing a personalized song, you acknowledge and consent to the use of such technology.
AI-generated or AI-assisted vocals are not representations that an identified real person performed the recording unless we expressly state otherwise.
5. Revisions
Your purchase includes only the revisions specifically described on the product page or in your selected package at the time of purchase.
Revision requests must relate to the original information and creative direction supplied with the order.
A request that substantially changes the original story, musical style, lyrics, recipient, occasion, concept, or other fundamental elements may be treated as a new order or may require an additional fee.
We do not guarantee that every requested revision can be accommodated.
6. Delivery
Completed songs are delivered digitally using the delivery method described at checkout or otherwise communicated to the customer.
Estimated completion or delivery times are estimates unless we expressly guarantee a specific delivery deadline in writing.
Customers are responsible for providing accurate contact information and for checking email folders, including spam or junk folders, for delivery communications.
7. Refunds and Cancellations
Because each personalized song is a custom digital product created specifically for the customer, all sales are final once production has begun, except where otherwise required by applicable law or where SongsMadePersonal expressly agrees to provide a refund.
An order may be eligible for cancellation before production begins. Any cancellation request should be submitted immediately.
Once substantial production has begun, a song has been completed, delivered, accessed, or downloaded, the order is not eligible for a refund merely because the customer changes their mind, no longer needs the song, or has a subjective preference for a different creative result.
Nothing in these Terms eliminates any non-waivable rights a consumer may have under applicable law.
8. Downloaded or Delivered Songs
Digital products cannot practically be returned after delivery in the same manner as physical merchandise.
By accepting these Terms, you acknowledge that once the personalized song has been delivered or made available to you, you may have received the substantial benefit of the customized product even though no physical item has been shipped.
Downloading, copying, saving, sharing, playing, or otherwise accessing the delivered song does not create a right to a refund.
9. Payment Disputes and Chargebacks
If you believe there is a problem with your order, you agree to contact SongsMadePersonal promptly so that we have a reasonable opportunity to investigate and attempt to resolve the issue.
Initiating a payment dispute or chargeback does not alter these Terms or independently establish that a refund is owed.
In responding to a payment dispute or chargeback, SongsMadePersonal may provide the payment processor, card issuer, bank, or other appropriate party with records relating to the transaction, including your order information, acceptance of these Terms, customization information, communications, revision history, and records demonstrating creation, delivery, access, or download of the personalized product, to the extent permitted by applicable law and our Privacy Policy.
Nothing in this section limits any dispute or chargeback right that cannot legally be waived.
10. Personal Use and Rights to the Song
Unless your order expressly includes commercial-use rights, your personalized song is licensed to you for personal, non-commercial use.
You may download it, store it, play it privately, share it with friends and family, and use it for the personal occasion for which it was created.
You may not sell, sublicense, commercially distribute, commercially exploit, or represent yourself as owning rights beyond those expressly granted with your purchase.
Any commercial-use rights must be expressly included in your purchased package or separately granted by SongsMadePersonal in writing.
11. Customer-Provided Material
You retain whatever rights you have in original material that you provide to us.
You grant SongsMadePersonal a limited license to use that material as reasonably necessary to create, revise, deliver, and support your personalized song and order.
You should not submit copyrighted lyrics, recordings, photographs, text, trademarks, or other protected material belonging to another person unless you have authorization to use it.
12. Publicity and Samples
SongsMadePersonal will not use a customer's personalized song, private story, photographs, or personally identifying materials for public advertising or promotional purposes without permission, except as otherwise disclosed and agreed at the time of purchase.
If a customer separately authorizes promotional use, the scope of that authorization will be governed by the permission provided.
13. Prohibited Content
We reserve the right to reject or cancel an order requesting content that is unlawful, threatening, defamatory, fraudulent, infringing, hateful, harassing, sexually exploitative, or otherwise inappropriate, or that we reasonably believe could violate another person's rights.
If an order is rejected before meaningful production has begun, the amount paid for the rejected order will ordinarily be refunded.
14. No Guarantee of Third-Party Platform Acceptance
We do not guarantee that a personalized song will be accepted, distributed, monetized, published, or permitted by any third-party service or platform, including social media, streaming, music distribution, advertising, or content-hosting platforms.
Third-party platforms maintain their own rules and may change those rules at any time.
15. Limitation of Liability
To the fullest extent permitted by applicable law, SongsMadePersonal will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of a personalized song.
To the fullest extent permitted by applicable law, SongsMadePersonal's aggregate liability relating to an individual order will not exceed the amount actually paid for that order.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
16. Force Majeure and Technical Issues
SongsMadePersonal is not responsible for reasonable delays or failures caused by events beyond our reasonable control, including internet or hosting failures, third-party service interruptions, payment processor outages, software failures, severe weather, natural disasters, governmental actions, or similar circumstances.
17. Governing Law
These Terms and purchases from SongsMadePersonal.com are governed by the laws of the State of New York, without regard to conflict-of-law principles, except to the extent applicable consumer law requires otherwise.
18. Dispute Resolution
Before filing a legal claim concerning an order, you and SongsMadePersonal agree to make a reasonable good-faith effort to resolve the dispute directly.
19. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
20. Entire Agreement
These Terms, together with the applicable product description, checkout disclosures, Privacy Policy, and any specific written terms applicable to your order, constitute the agreement between you and SongsMadePersonal concerning your purchase.

BY CHECKING THE TERMS-OF-SERVICE BOX AND SUBMITTING YOUR ORDER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS OF SERVICE.
